Under the right circumstances, married couples in Kansas and Missouri often choose to end their marriage through an uncontested divorce. This is the simplest and most inexpensive form of divorce and also helps the individual parties maintain their individual and collective dignity and privacy. If you and your spouse are on relatively good terms and are able to agree on all material issues that will need to be brought before the court, your case can remain uncontested and will likely be much easier, simpler, and less expensive. When a couple cannot agree on how to settle all material terms of the divorce, such as asset division, division of marital debt, whether maintenance or spousal support will be paid, as well as custody parenting time and visitation, the divorce will become contested and can be extremely complicated and expensive.
It is important to hire a good divorce lawyer whether your Kansas or Missouri divorce is uncontested or not. The first thing your lawyer will do is ask you questions; questions about the marriage, about your goals, and about what you want out of the case. A good divorce lawyer will gather all of the pertinent information, carefully analyze your case, and then advise you regarding what your rights are and what you are entitled to under the law. If you and your spouse are able to agree on terms that are in line with your lawyer’s recommendations and in line with what you are entitled to under the law, the case will generally remain uncontested and settle rather easily as both parties are incentivized to do so. If, however, the nature of your case or of the party on the other side of the table dictates that conflict is inevitable, you will want a good Kansas City divorce lawyer on your side, someone who will fight for you and protect your rights under any circumstance.
Uncontested divorce is the best way to get divorced. It is simpler, easier and less expensive than a contested divorce litigation. Still, you should not opt for the cheaper, easier option at the expense of your rights. If the other party is not willing to be reasonable or if there are deep divisions on issues such as child custody, visitation or maintenance (spousal support), the proper path may call for litigation.
In determining whether an uncontested divorce is the right path to take, it is best to speak to an experienced divorce lawyer who can properly advise you regarding your rights and then help you protect them.
